Some commodities, technology and software for export are subject to licensing according to Part 730.7 of the EAR. Products that are included in the Commerce Control List (CCL), found in Supplement 1 to part 774 of the EAR may require an export license for shipment to a limited number of destinations. Other transactions may be covered by one or more of the License Exceptions in the EAR.

DETERMINATION

Export Control Classification Number (ECCN Location):

The CCL is divided into 10 categories, numbered as follows:

0- Nuclear Materials, Facilities and Equipment and Miscellaneous
1- Materials, Chemicals, Microorganisms, and Toxins
2- Materials Processing
3- Electronics
4- Computers
5- Telecommunications and Information Security
6- Lasers and Sensors
7- Navigation and Avionics
8- Marine
9- Propulsion Systems, Space Vehicles and Related Equipment

Within each of the above categories, items are arranged by groups as follows:

A- Equipment, Assemblies and Components
B- Test, Inspection and Production Equipment
C- Materials
D- Software
E- Technology

Product/Country License Determination Matrix

An Example:
Under the appropriate heading for ECCN Number 5D992 “Information Security” software, the reason for control is specified as “AT” (Anti-terrorism). Using the country chart provided, the countries checked in the “AT” column are North Korea, Sudan and Syria. In addition, Cuba, Iran, Iraq* and Libya are also restricted.

License Exception that applies to this category is TSU. However, for “AT” reasons, the License Exception is not available. Therefore, we may not export our product to Cuba, Iran, Iraq*, Libya, North Korea, Sudan and  Syria because these countries are either on the restricted list or have an ‘X’ under AT1/AT2 for Anti-terrorism. Within the Ten General Prohibitions, the first three General Prohibitions apply whenever the item is controlled under an ECCN on the CCL.

Three-digit License Exception codes are listed in order of appearance in CFR 15 Part 740.2 to 740.18 and not alphabetically.

DOCUMENTATION

For all shipments that do not require an export license, “NLR” should be filled in Box 27 of the Shipper’s Export Declaration (SED).

For all shipments of products that are not controlled with an EECN number, “EAR99” should be filled in Box 28 of the Shipper’s Export Declaration (SED).

The correct way to fill out the Shipper’s Export Declaration (SED) is on U.S. Customs web site at http:// www.census.gov/foreign-trade/www/correct.way.html

The procedure to submit a request for classification is as follows:
